Welcome to Bon Secours 24/7 telemedicine service (the "Service"). To use the Service you must agree to be bound by all of the terms of the Agreement. By clicking the "AGREE" checkbox, you are indicating that you agree to be bound by all of the terms in this Agreement. If you do not agree to this Agreement, you are not authorized to access or use this website.

Please print and keep a copy of this Agreement. Bon Secours 24/7 may, from time to time, at its convenience, change the terms of this Agreement. It is your responsibility to review these terms each time you use this website.

Terms of Use

IMPORTANT INFORMATION ABOUT YOUR USE OF THE SERVICE:

DO NOT USE THIS SITE FOR EMERGENCY MEDICAL NEEDS. IF YOU EXPERIENCE A MEDICAL EMERGENCY CALL 911 IMMEDIATELY. The third-party technology platform provider utilized by Bon Secours 24/7 to provide the Service is not itself a medical provider and is not responsible for the medical advice provided to you by Bon Secours 24/7. Your interactions with Bon Secours 24/7 via the Service are not intended to take the place of your relationship with your regular health care practitioners. Bon Secours 24/7 suppliers or any third parties who promote the Service on its behalf or provide you with a link to the Service shall not be liable for any professional advice you obtain from a healthcare provider via the Service. You acknowledge that your reliance on information provided by the Service is solely at your own risk and you assume full responsibility for all risk associated therewith.

Geographic Restrictions

You hereby certify that you are physically located in the State you choose/have chosen as your current location. You acknowledge that your ability to access and use the Service is conditioned upon the truthfulness of this certification and that the providers you access are relying upon this certification in order to interact with you. In the event that your certification is inaccurate, you agree to indemnify Bon Secours 24/7, its third-party technology platform provider and the providers you interact with from any resulting damages, costs or claims.

OVERVIEW OF TELEMEDICINE SERVICE

Telemedicine involves the use of electronic communications to enable health care providers at sites remote from patients to provide consultative services. Providers may include primary care practitioners, specialists, and/or subspecialists. The information you provide may be used for diagnosis, therapy, follow-up and/or education, and may include live two-way audio and video and other materials (e.g. medical records, data from medical devices).

The communications systems used will incorporate network and software security protocols to protect the confidentiality of patient information and will include reasonable measures to safeguard the data and to ensure its integrity against intentional or unintentional corruption.

An encounter summary will be provided to you at the end of each encounter, which may be kept for your records and may be shared with other providers for treatment purposes or as otherwise permitted or required by law.

ANTICIPATED BENEFITS OF TELEMEDICINE

  1. Improved access to medical care by enabling a patient to remain at his or her home or office while consulting a clinician.
  2. More efficient medical evaluation and management.

POSSIBLE RISKS OF TELEMEDICINE

As with any medical procedure, there are potential risks associated with the use of telemedicine. Bon Secours 24/7 believes that the likelihood of these risks materializing is very low. These risks may include, without limitation, the following:

  1. Delays in medical evaluation and consultation or treatment may occur due to deficiencies or failures of the equipment.
  2. Security protocols could fail, causing a breach of privacy of personal medical information.
  3. Lack of access to complete medical records may result in adverse drug interactions or allergic reactions or other negative outcomes.

WEBSITE CONTENT

Other than information received directly by you from providers, the content on the website should not be considered medical advice. You should always talk to an appropriately qualified health care professional for diagnosis and treatment, including requesting information regarding which medications or treatment may be appropriate for you. None of the content on this website represents or warrants that any particular medication or treatment is safe, appropriate, or effective for you. Without limitation, Bon Secours 24/7 does not recommend or endorse any specific tests, medications, products or procedures.

SECURITY

Bon Secours 24/7, through its third-party technology platform provider, has implemented a variety of commercially standard encryption and security technologies and procedures to protect your personal information stored in its computer system from unauthorized access. Bon Secours 24/7 and its third-party technology platform provider also maintain standard physical and electronic procedural safeguards that limit access to your personal information to their respective employees and contractors (or people working on our behalf and under confidentiality agreements) who, through the course of standard business activities, need to access your personal information.

Access to the Service is enabled only by usernames and passwords. You should maintain your username and password in strict confidence. In no event should you share your username or password with any third-party or allow another person to access the Service using your username and password. Please notify Bon Secours 24/7 if you have any reason to believe that your username or password has been lost or compromised or misused in any way. You are fully and solely responsible for any and all use of the Service using your username and password. Bon Secours 24/7 reserves the right to revoke or deactivate your username and password at any time and for any reason.

ACCOUNT ENROLLMENT

To access the Service, you must first enroll to establish an individual user account ("Account"), by providing certain information. With the exception of subaccounts established for minor children of whom you are a parent or legal guardian, you agree that you will not create more than one Account, or create an account for anyone other than yourself without first receiving permission from the other person. In exchange for your use of the Service and, if applicable, in order for Bon Secours 24/7 to send notices to you, you agree to: (i) provide true, accurate, current and complete information about yourself as prompted by our Account enrollment form; and (ii) each time you log on, maintain and promptly update such Account information to keep it true, accurate, current and complete. If you provide any information that is untrue, inaccurate, not current or incomplete, or Bon Secours 24/7 has reasonable grounds to suspect that such Account information is untrue, inaccurate, not current or incomplete, Bon Secours 24/7 reserves the right to suspend or terminate your Account and refuse any and all current or future use of the Service. You represent and warrant that you are at least 18 years of age and possess the legal right and ability, on behalf of yourself or a minor child of whom you are a parent or legal guardian, to agree to this Agreement.

ACCEPTABLE USE

You agree not to access or use the Service in an unlawful way or for an unlawful or illegitimate purpose or in any manner that contravenes this Agreement. You shall not post, use, store or transmit (a) a message or information under a false name; (b) information that is unlawful, libelous, defamatory, obscene, fraudulent, predatory of minors, harassing, threatening or hateful to any person; or (c) information that infringes or violates any of the intellectual property rights of others or the privacy or publicity rights of others. You shall not attempt to disrupt the operation of the Service by any method, including through use of viruses, Trojan horses, worms, time bombs, denial of service attacks, flooding or spamming. You shall not use the Service in any manner that could damage, disable or impair the Service. You shall not attempt to gain unauthorized access to any user accounts or computer systems or networks, through hacking, password mining or any other means. You shall not use any robot, scraper or other means to access the Service for any purpose.

OPERATION AND RECORD RETENTION

Bon Secours 24/7 and its third-party platform provider reserves complete and sole discretion with respect to the operation of the Service. Bon Secours 24/7, through its third-party platform provider, may, among other things withdraw, suspend or discontinue any functionality or feature of the Service. Subject to applicable law, Bon Secours 24/7 reserves the right to maintain, delete or destroy all communications and materials posted or uploaded to the Service pursuant to its internal record retention and/or destruction policies.

LINKS

Areas of the Service or Bon Secours 24/7's portal may contain links to other web sites. Please note that when you click on any of these links, you are entering another web site for which Bon Secours 24/7 has no responsibility or control. The inclusion of any link does not imply affiliation, endorsement or adoption by us of the linked site or any medical or other information contained therein. Bon Secours 24/7 encourages you to read the terms and conditions, data-gathering practices and privacy policies of all linked sites to which you may be bound, as they may materially differ from ours. You agree that Bon Secours 24/7 shall not be responsible for any loss or damage of any sort incurred as a result of any such links or as the result of the presence of such links on this site. It is up to you to take precautions to ensure that whatever linked material you select is free of items such as viruses, worms, Trojan horses and other destructive items.

INTELLECTUAL PROPERTY

All of the content available on or through the Service is the property of Bon Secours 24/7 or its licensors and is protected by copyright, trademark, patent, trade secret and other intellectual property law. Bon Secours 24/7 gives you permission to display, download, store and print the content only for your personal, non-commercial use. You agree not to reproduce, retransmit, distribute, disseminate, sell, publish, broadcast, or circulate the content received through the Service to anyone. All software and accompanying documentation made available for download from the Service is the copyrighted work of Bon Secours 24/7 or its licensors. Any copy made of information obtained through the Service must include all applicable copyright notices.

All Bon Secours 24/7 trade and service names, including, but not limited to "Bon Secours 24/7®", are trademarks of Bon Secours 24/7. All other brands and names are the property of their respective owners, including those related to Bon Secours 24/7's third-party technology platform provider. Nothing contained in the Service should be construed as granting any license or right to use any trademark displayed on this site without the express written permission of Bon Secours 24/7 or such third-party that may own the trademark.

Subject to the terms of this Agreement, Bon Secours 24/7 through its third-party technology platform provider, hereby grants you a limited, revocable, non-transferable and non-exclusive license to use the software, network facilities, content and documentation on and in the Service to the extent, and only to the extent, necessary to access and use the Service.

The license granted herein does not permit you, and you agree not to: (a) modify, translate, reverse engineer, disassemble, decompile or create derivative works of the Service or allow a third-party, whether directly or indirectly (including, but not limited to the direct or indirect use of wizards, agents, bots, or other utilities), to modify, translate, reverse engineer, disassemble, decompile or create derivative works of the Service; or (b) transfer, distribute, sell, lease, rent, disclose or provide access to the Service to any third-party or use the Service to provide service bureau, time sharing or other services to third parties.

DISCLAIMERS

ACCESS TO THE SERVICE AND THE INFORMATION CONTAINED THEREIN IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMISSIBLE PURSUANT TO APPLICABLE LAW, BON SECOURS 24/7 AND ITS THIRD-PARTY TECHNOLOGY PLATFORM PROVIDER DISCLAIMS ALL WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO ANY IMPLIED WARRANTIES OF TITLE, MERCHANTIBILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT.

WITHOUT LIMITING THE FOREGOING, BON SECOURS 24/7 DOES NOT WARRANT THAT ACCESS TO THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT DEFECTS, IF ANY, WILL BE CORRECTED; NOR DOES BON SECOURS 24/7 MAKE ANY REPRESENTATIONS ABOUT THE ACCURACY, RELIABILITY, CURRENCY, QUALITY, COMPLETENESS, USEFULNESS, PERFORMANCE, SECURITY, LEGALITY OR SUITABILITY OF THE SERVICE OR ANY OF THE INFORMATION CONTAINED THEREIN. YOU EXPRESSLY AGREE THAT YOUR USE OF THE SERVICE AND YOUR RELIANCE UPON ANY OF ITS CONTENTS IS AT YOUR SOLE RISK.

YOU SHALL BE SOLELY AND FULLY RESPONSIBLE FOR ANY DAMAGE TO THE SERVICE OR ANY COMPUTER SYSTEM, ANY LOSS OF DATA, OR ANY IMPROPER USE OR DISCLOSURE OF INFORMATION ON THE SERVICE CAUSED BY YOU OR ANY PERSON USING YOUR USERNAME OR PASSWORD. BON SECOURS 24/7 CANNOT AND DOES NOT ASSUME ANY RESPONSIBILITY FOR ANY LOSS, DAMAGES OR LIABILITIES ARISING FROM THE FAILURE OF ANY TELECOMMUNICATIONS INFRASTRUCTURE, OR THE INTERNET OR FOR YOUR MISUSE OF ANY PROTECTED HEALTH INFORMATION, ADVICE, IDEAS, INFORMATION, INSTRUCTIONS OR GUIDELINES ACCESSED THROUGH THE SERVICE.

LIMITATIONS OF LIABILITY

IN THE EVENT OF ANY PROBLEM WITH THE SERVICE OR ANY OF ITS CONTENT, YOU AGREE THAT YOUR SOLE REMEDY IS TO CEASE USING THE SERVICE. UNDER NO CIRCUMSTANCES SHALL BON SECOURS 24/7, ITS THIRD-PARTY TECHNOLOGY PLATFORM PROVIDER OR SUPPLIER, OR ANY THIRD-PARTY WHO PROMOTES THE SERVICE OR PROVIDES YOU WITH A LINK TO THE SERVICE BE LIABLE IN ANY WAY FOR YOUR USE OF THE SERVICE OR ANY OF ITS CONTENT, INCLUDING, BUT NOT LIMITED TO, ANY ERRORS OR OMISSIONS IN ANY CONTENT, ANY INFRINGEMENT BY ANY CONTENT OF THE INTELLECTUAL PROPERTY RIGHTS OR OTHER RIGHTS OF THIRD PARTIES, OR FOR ANY LOSS OR DAMAGE OF ANY KIND INCURRED AS A RESULT OF THE USE OF ANY CONTENT.

UNDER NO CIRCUMSTANCES SHALL BON SECOURS 24/7, ITS THIRD-PARTY TECHNOLOGY PLATFORM PROVIDER OR SUPPLIERS OR ANY THIRD-PARTY WHO PROMOTES THE SERVICE OR PROVIDES YOU WITH A LINK TO THE SERVICE, BE LIABLE FOR ANY PUNITIVE, EXEMPLARY, CONSEQUENTIAL, INCIDENTAL, INDIRECT OR SPECIAL DAMAGES (INCLUDING, WITHOUT LIMITATION, ANY PERSONAL INJURY, LOST PROFITS, BUSINESS INTERRUPTION, LOSS OF PROGRAMS OR OTHER DATA ON YOUR COMPUTER OR OTHERWISE) ARISING FROM OR IN CONNECTION WITH YOUR USE OF THE SERVICE, WHETHER UNDER A THEORY OF BREACH OF CONTRACT, NEGLIGENCE, STRICT LIABILITYOR OTHERWISE, EVEN IF BON SECOURS 24/7 OR THEY HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

YOU HEREBY RELEASE AND HOLD BON SECOURS 24/7, ITS THIRD-PARTY TECHNOLOGY PLATFORM PROVIDER, SUPPLIERS AND PROVIDERS AND ANY THIRD-PARTY WHO PROMOTES THE SERVICE OR PROVIDES YOU WITH A LINK TO THE SERVICE HARMLESS FROM ANY AND ALL CLAIMS, DEMANDS, AND DAMAGES OF EVERY KIND AND NATURE (INCLUDING, WITHOUT LIMITATION, ACTUAL, SPECIAL, INCIDENTAL AND CONSEQUENTIAL), KNOWN AND UNKNOWN, SUSPECTED AND UNSUSPECTED, DISCLOSED AND UNDISCLOSED, ARISING OUT OF OR IN ANY WAY CONNECTED WITH YOUR USE OF THE SERVICE. YOU WAIVE THE PROVISIONS OF ANY STATE OR LOCAL LAW LIMITING OR PROHIBITING A GENERAL RELEASE.

YOU ACKNOWLEDGE AND AGREE THAT BON SECOURS 24/7'S THIRD-PARTY TECHNOLOGY PLATFORM PROVIDER IS NOT ENGAGED IN THE PRACTICE OF MEDICINE AND THAT IT IS NOT DETERMINING APPROPRIATE MEDICAL USE OF THE SERVICE. IT, ITS LICENSORS, SUPPLIER AND ALL THIRD PARTIES WHO PROMOTE THE SERVICE OR PROVIDE YOU WITH A LINK TO THE SERVICE EXPRESSLY DISCLAIMS ANY AND ALL LIABILITY RESULTING FROM THE DELIVERY OF HEALTHCARE VIA THE SERVICE, INCLUDING, BUT NOT LIMITED TO LIABILITY FOR MEDICAL MALPRACTICE. BON SECOURS 24/7 IS THE PARTY PROVIDING THE TELEMEDICINE SERVICE.

INTERNATIONAL USE

The Service is designed for and intended for users in the United States. Bon Secours 24/7 makes no representation that the information and services provided on the Service are applicable to, appropriate for, or available to users in locations outside the United States. Accessing the Service from territories where the content is illegal is prohibited. If you choose to access the site from a location outside the U.S., you do so on your own initiative and you are responsible for compliance with local laws.

TERMINATION

Bon Secours 24/7 or its' third-party technology platform provider, if directed by Bon Secours 24/7, may suspend or terminate your access to the Service at any time, for any reason or for no reason at all. Bon Secours 24/7 has the right (but not the obligation) to refuse to provide access to the Service to any person, agency or organization at any time, for any reason or for no reason at all, in our sole discretion. Bon Secours 24/7 reserves the right to change, suspend, or discontinue all or part of the Service, temporarily or permanently, without prior notice. Bon Secours 24/7 reserves the right to delete or change any username or password at any time, for any reason or for no reason at all.

INDEMNIFICATION

Without limiting the generality or effect of other provisions of this Agreement, as a condition of use, you agree to indemnify, hold harmless, and defend Bon Secours 24/7, its third-party technology platform provider, and its parents, subsidiaries, affiliates, licensors, suppliers and their officers, directors, affiliates, subcontractors, agents and employees (collectively, "Indemnified Parties" and each, individually, an "Indemnified Party") against all costs, expenses, liabilities and damages (including reasonable attorney's fees) incurred by any Indemnified Party in connection with any third-party claims arising out of: (i) your failure to comply with any applicable laws and regulations; and (ii) your breach of any of its obligations set forth in this Agreement. You shall not settle any such claim without the prior written consent of the applicable indemnified party.

ELECTRONIC CONTRACTING AND NOTICES

Your assent to the terms of this Agreement by clicking the "AGREE" checkbox. You agree that Bon Secours 24/7 may send to you in electronic form any privacy or other notices, disclosures, reports, documents, communications or other records regarding the services (collectively, "Notices"). Bon Secours 24/7 may send you electronic Notices (1) to the e-mail address that you provided to us during registration, or (2) by posting the Notice on the Service or otherwise through our site. The delivery of any Notice from us is effective when sent by us, regardless of whether you read the Notice when you receive it or whether you actually receive the delivery. You can withdraw your consent to receive Notices electronically by canceling or discontinuing your use of the applicable service.

PATIENT ACKNOWLEDGEMENT AND CONSENT

By clicking the applicable "AGREE" checkbox below, I am indicating that I have reviewed and acknowledge and consent to the terms described below:

1. I understand that I may expect the anticipated benefits from the use of telemedicine in my care, but that no results can be guaranteed or assured.

2. I have read and understand the information provided above, and understand the risks and benefits of telemedicine, and by accepting these Terms of Use I hereby give my informed consent to participate in a telemedicine visit under the terms described herein.

3. I authorize Bon Secours 24/7 to charge my credit card for the full amount due from me with respect to my consultation. I further acknowledge that Bon Secours 24/7 may not be given full or complete information from my health plan regarding the applicable co-pay due from me for your consultation. As such, I may be billed multiple times with respect to a consultation - once prior to beginning the visit and a second time once your health plan has advised us as to what additional co-pays, if any, you owe. 

4. I understand that this authorization to bill my credit card will remain in effect until I cancel it in writing, and I agree to notify Bon Secours 24/7 in writing of any changes in my account information. In the case of an ACH Transaction being rejected for Non-Sufficient Funds (NSF), I understand that Bon Secours 24/7 may at its discretion attempt to process the charge again at any time within 30 days. I acknowledge that the origination of ACH transactions to my account must comply with the provisions of U.S. law. I certify that I am an authorized user of this credit card/bank account and will not dispute these scheduled transactions with my bank or credit card company so long as the transactions correspond to the co-payment required by my health plan.

5. I understand that the laws that protect privacy and the confidentiality of medical information also apply to telemedicine; I have received Bon Secours 24/7's Notice of Privacy Practices, set forth below, which explains these issues in greater detail. 

6. I understand that telemedicine may involve electronic communication of my personal medical information to medical practitioners who may be located in other areas, including out of state.

7. I understand that my healthcare information may be shared with other individuals for treatment, payment and healthcare operations purposes. Psychotherapy notes may be maintained by my Provider, but will not be shared with others without my authorization or as required by law, while billing codes and encounter summaries are shared with others and with me. If I obtain behavioral health treatment from a Provider, I understand that my therapist has the right to limit the information provided to me if, in my therapist's professional judgment, sharing the information with me would be harmful to me.

APPLE HEALTHKIT (AND OTHER SIMILAR DEVICES)

Under ioS8, Apple has launched its Health app that collects certain data which may include data that could be interpreted to be protected health information from the user of the app. Health is marketed by Apple to aid consumers in aggregating their data. When using this Service you may be asked if you would like to share certain data, including purported protected health information collected by Apple Health with Bon Secours 24/7. YOU AGREE AND UNDERSTAND THAT UNTIL EXPRESSLY DIRECTED BY THE BON SECOURS 24/7 PROVIDER TO "SYNC" AND IMPORT DATA TO THE BON SECOURS 24/7 SERVICE, THIS DATA WILL NOT BE USED OR RELIED UPON BY THE BON SECOURS 24/7 PROVIDER IN MAKING ANY MEDICAL DECISIONS. EVEN IF YOU SELECTED TO "SYNC", THIS DATA IS NOT CONSIDERED PART OF YOUR MEDICAL RECORD FOR THE PURPOSES OF INTERACTING WITH BON SECOURS 24/7 PROVIDERS.

MISCELLANEOUS

This Agreement shall be governed by the laws of the Commonwealth of Virginia without regard to its rules on conflicts or choice of law. You hereby consent to the exclusive jurisdiction of the courts of the Commonwealth of Virginia for the resolution of any dispute based upon or relating to this Agreement. This Agreement constitutes the sole Agreement between you and Bon Secours 24/7 relating to your use and our provision of the Service and the subject matter hereof, and no representations, statements or inducements, oral or written, not contained in this Agreement shall bind either you or Bon Secours 24/7. Any of the terms of this Agreement which are determined to be invalid or unenforceable shall be ineffective to the extent of such invalidity or unenforceability, without rendering invalid or unenforceable any of the remaining terms of this Agreement or affecting the validity or enforceability of the Agreement as a whole. Failure to insist on performance of any of the terms of the Agreement will not operate as a waiver of any subsequent default. No waiver by Bon Secours 24/7 of any right under this Agreement will be deemed to be either a waiver of any other right or provision or a waiver of that same right or provision at any other time. You may not assign, transfer or delegate your rights or obligations hereunder, in whole or in part. This Agreement shall be binding upon and inure to the benefit of each of the parties and the parties' respective successors and permitted assigns. Except as otherwise specifically provided herein, this Agreement may not be modified, supplemented, qualified, or interpreted except in writing signed by the parties.

A printed version of this Agreement and of any related notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to this Agreement to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form.

Notice of Privacy Practices

THIS NOTICE DESCRIBES HOW MEDICAL INFORMATION ABOUT YOU MAY BE USED AND DISCLOSED AND HOW YOU CAN GET ACCESS TO THIS INFORMATION. PLEASE REVIEW IT CAREFULLY.
A printed version of this Agreement and of any related notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to this Agreement to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form.

OUR PLEDGE REGARDING YOUR MEDICAL INFORMATION:

Bon Secours 24/7 is committed to protecting medical information about you. Bon Secours 24/7 creates a record of the medical care and services you receive through the Service. Bon Secours 24/7 need this record to provide you with quality care and to comply with certain legal requirements. This notice applies to all the records of your care relating to professional services provided through the Bon Secours 24/7 Service. 

This notice tells you about the ways in which Bon Secours 24/7 may use and disclose medical information about you. It also describes your rights and certain obligations Bon Secours 24/7 have regarding the use and disclosure of your information. 

We are required by law to:
  • make sure that your medical information is protected;
  • give you this Notice describing our legal duties and privacy practices with respect to your medical information; and
  • follow the terms of the Notice that is currently in effect.

WHO WILL FOLLOW THIS NOTICE?

This notice describes the practices of Bon Secours 24/7 and all physicians providing professional services through the Service (collectively, "we").

HOW WE MAY USE AND DISCLOSE MEDICAL INFORMATION ABOUT YOU

Treatment: We may use or disclose medical information about you to provide you with medical treatment or services. We may disclose information about you to doctors, nurses, technicians, students or other personnel involved in taking care of you. For example, if we treat you for an infection or allergic reaction, we may send a prescription to the pharmacy of your choice so proper medications can be ordered. We may share medical information about you with Bon Secours 24/7 personnel or other health care providers, agencies, or facilities not affiliated with Bon Secours 24/7 in order to provide or coordinate the different things you need, such as lab work, and X-rays. If you have an existing relationship with a Bon Secours practitioner or facility, we may share the record of your Bon Secours 24/7 telehealth visits with such affiliated practitioner or facility. If your record is so shared, the future use or disclosure of your telehealth visits will be governed by the Notice of Privacy Practices of the affiliated practitioner or facility. We may disclose information about your care to any doctor you identify as a provider of medical care to you, even if that doctor is not a direct participant in a given episode of care provided through Bon Secours 24/7. 

Payment: We may use and disclose medical information about you so for payment activities of Bon Secours 24/7. For example, we may use and disclose information so that Bon Secours 24/7 or others involved in your care can obtain payment from you, an insurance company or another third party. We may disclose your information to the Social Security Administration, or any other person or insurance or benefit payor, health care service plan or worker's compensation carrier which is, or may be responsible for all or part of your bill. For example, we may give your insurance company information about treatment provided through Bon Secours 24/7 so they will pay us or reimburse you for the care provided. We may tell your insurance company about a proposed treatment to determine whether or not they will pay for the treatment or to resolve an appeal or complaint/grievance. However, if you pay in in cash in advance for your treatment, and you ask us not to disclose your health information to your insurance company with regard to that treatment, we will honor your request.

Health Care Operations: We may use and disclose medical information about you for our health care operations and for certain health care operations of other providers who furnish care to you. These uses and disclosures are necessary to operate Bon Secours 24/7 and to make sure that all of our patients receive quality services. For example, we may use medical information to review our treatment and services, to evaluate the performance of our staff, and to survey you on your satisfaction with our treatment and/or services. We may review and/or aggregate medical information to decide what additional services or health benefits Bon Secours 24/7 should offer, what services are not needed, and whether certain new treatments are effective. We may disclose information to doctors, nurses, technicians, students training with Bon Secours 24/7, and other Bon Secours 24/7 personnel for review and learning purposes. We may combine the medical information we have with medical information from other health care entities to compare how we are doing and see where we can make improvements in the care and services we offer. Bon Secours 24/7 may disclose information to private accreditation organizations, such as The Joint Commission, in order to obtain accreditation from these organizations. 

Business Associates: We may share your medical information with third-parties referred to as "business associates". Business associates provide various services to or for Bon Secours 24/7. Examples include web platform hosting services, billing services, transcription services and legal services. We require our business associates to sign an agreement requiring them to protect your information and to use it only for the purposes for which we have contracted for their services in an effort to make sure your medical information is appropriately safeguarded.

Fundraising Activities: We may contact you to provide information about Bon Secours 24/7-sponsored activities, including fund-raising programs and events. You may request to "opt out" of fund raising communications if you do not wish to be contacted.

Individuals Involved in Your Care or Payment for Your Care: Unless you tell us not to, we may release medical information to anyone involved in your medical care, such as a friend, family member, or any individual you identify. We also may give your information to someone who helps pay for your care. Additionally, we may disclose information about you to your legal representative. If a person has the authority by law to make healthcare decisions for you, Bon Secours 24/7 typically will treat that legal representative the same way we would treat you with respect to your medical information. Parents and legal guardians are generally patient representatives of minors unless the minors are permitted by law to act on their own behalf and make their own medical decisions in certain circumstances.

Research: We may use and disclose medical information about you for certain research purposes in compliance with the requirements of applicable federal and state laws. All research projects, however, are subject to a special approval process, which establishes protocols to ensure that your health information will continue to be protected. When required, we will obtain a written authorization from you prior to using your health information for research.

As Required or Authorized by Law: We will disclose medical information about you when required to do so by federal and/or state law. This includes, but is not limited to, disclosures to mandated patient registries, including reporting adverse events with medical devices, food, or prescription drugs to the FDA. We also may disclose medical information to health oversight agencies for activities authorized by law. These oversight activities may include licensure activities and other activities by governmental, licensing, auditing and accrediting agencies as authorized or required by law. We may disclose your health information for public health activities including disclosures to prevent or control disease, injury or disability; report births and deaths; report child abuse or neglect; or notify a person who may have been exposed to a disease or condition. We may disclose information for law enforcement purposes as required by law or in response to a valid subpoena, summons, court order, or similar process.

Legal Proceedings, Lawsuits and Other Legal Actions: We may disclose medical information about you to courts, attorneys, court employees and others when we get a court order, subpoena, discovery request, warrant, summons or other lawful instructions. We also may disclose information about you to Bon Secours 24/7's attorneys and/or attorneys working on Bon Secours 24/7's behalf to defend ourselves against a lawsuit or action brought against us.

We may use and disclose your medical information in the following special situations:

  • Disaster-Relief Efforts: We may disclose medical information about you to an organization assisting in a disaster-relief effort so that your family can be notified about your condition, status and location. If you do not want us to disclose your medical information for this purpose, you must tell your caregivers so that we do not disclose this information unless we must do so to respond to the emergency.
  • To Avert a Serious Threat to Health or Safety: We may use and disclose medical information about you to help prevent a serious and imminent threat to your health and safety or the health and safety of the public or another person.
  • Organ, Eye and Tissue Donation: We may release information to organizations that handle organ procurement, eye or tissue transplantation or to an organ donation bank, as necessary to facilitate organ or tissue donation and transplantation.
  • Military: If you are a member of the armed forces, domestic (United States) or foreign we may release medical information about you to the military authorities as authorized or required by law.
  • Workers' Compensation: We may disclose medical information about you for workers' compensation or similar programs as authorized or required by law.
  • Coroners, Medical Examiners and Funeral Directors: We may disclose medical information to a coroner, medical examiner or funeral director as necessary for them to carry out their duties.
  • National Security and Intelligence Activities: We may disclose medical information about you to authorized federal officials for intelligence, counterintelligence and other national security activities as required by law.
  • Protective Services for the President of the United States and Others: We may disclose medical information about you to authorized federal officials so they may conduct special investigations or provide protection to the President of the United States, other authorized persons or foreign heads of state as authorized by law.
  • Inmates: If you are an inmate of a correctional institution or under the custody of law enforcement officials, we may release medical information about you to the correctional institution or law enforcement officials as authorized or required by law.

USES OF MEDICAL INFORMATION REQUIRING AUTHORIZATION

Psychotherapy Notes: We must obtain your written permission to disclose psychotherapy notes except in certain circumstances. For example, written permission is not required for use of those notes by the author of the notes with respect to your treatment, or use or disclosure by us for training of mental health practitioners, or to defend Bon Secours 24/7 in a legal action brought by you.

Marketing: We must obtain your written permission to use or disclose your medical information for marketing purposes except in certain circumstances. For example, written permission is not required for face-to-face encounters involving marketing, or where we are providing a gift of nominal value (example: a coffee mug), or a communication about our own services or products (example: we may send you a postcard announcing the arrival of a new on-line service or provider). 

Sale of PHI: We must obtain your written permission to disclose your medical information in exchange for remuneration.

Other Uses and Disclosures: Other Uses and Disclosures of your PHI not covered by the categories included in this Notice or applicable laws, rules or regulations will be made only with your written permission or authorization. If you provide us with such written permission, you may revoke it at any time. We are not able to take back any Uses or Disclosures that we already made with your authorization. We are required to retain your medical information regarding the care and treatment that we provided to you.

YOUR RIGHTS REGARDING MEDICAL INFORMATION ABOUT YOU

You have the following rights regarding your medical information:

Right to Inspect and Copy: With certain exceptions, you have the right to inspect and/or receive a copy of your medical and billing records or any other of our records that are used by us to make decisions about your care. The exceptions to this are any psychotherapy notes, information collected for certain legal proceedings and any medical information restricted by law.

To inspect and/or receive a copy of your medical records we require that you submit your request in writing to Bon Secours 24/7 Privacy Officer at the address listed below. If you request a copy of your medical records, we may charge you a reasonable fee for the costs of copying, mailing or other supplies associated with your request. Under certain circumstances, we may deny your request to inspect or copy your records such as if we believe it may endanger you or someone else. If you are denied access to your medical information, you may request that the denial be reviewed by another licensed health care professional. We will comply with the outcome of the review.

Right to Request an Amendment: If you feel that the medical information we have about you is incorrect or incomplete, you may ask us to amend the information for as long as the information is kept by or for Bon Secours 24/7 in your medical and billing records. To request an amendment, your request must be submitted in writing and provide the reason for the request. If we agree to your request, we will amend your record(s) and notify you of such. In certain circumstances, we cannot remove what was in the record(s), but we may add supplemental information to clarify. If we deny your request for an amendment, we will provide you with a written explanation of why we denied it and explain your rights. 

Right to an Accounting of Disclosures: You have a right to receive a list of certain of the disclosures we have made of your medical information in the six years prior to your request. To request an accounting of disclosures you must submit your request in writing to the Privacy Officer. You must state the time period for which you want to receive the accounting, which may not be longer than six years and which may not date back more than six years from the date of your request. You must indicate whether you wish to receive the list electronically or on paper. The first accounting you receive in a 12 month period will be free. We may charge you for responding to additional requests in that same period. We will inform you of the costs involved before any costs are incurred. You may choose to withdraw or modify your request at that time.

Right to Request Restrictions: You have the right to request a restriction or limitation on the medical information we use or disclose about you for treatment, payment or health care operations. You also have the right to request a limit on the medical information we disclose about you to someone who is involved in your care or the payment for your care, such as a family member or friend. For example, you could ask that we not disclose information to a family member about a medication we prescribed for you. If we agree to your request, we will comply with your request unless the information is needed to provide you with emergency treatment or we are required by law to disclose it. We are not required to agree to your request except in the case where the disclosure is to a health plan for purposes of carrying out payment or health care operations of the health plan, and the information pertains solely to a health care item or service for which we have been paid out of pocket in full. For example, when a patient wants treatment and pays for it out of pocket, upon request we will not send any claim to the insurance carrier. 

To request a restriction you must make your request in writing and tell us (1) what information you want to limit, (2) whether you want to limit our use, disclosure or both, and (3) to whom you want the limits to apply (e.g., disclosures to your spouse). We are allowed to end the restriction if we tell you. If we end the restriction, it will only affect the health information that was created or received after we notify you.

Right to Request Confidential Communications: You have the right to request that we communicate with you about medical matters in a certain way or at a certain location. For example, you may ask that we contact you only at home or by mail. If you want us to communicate with you in a certain way, you will need to give us specific details about how you want to be contacted including a valid alternative address. We will not ask you the reason for the request, and we will accommodate all reasonable requests. However, if we are unable to contact you using the ways or locations you have requested we may contact you using the information we have.

Right to a Paper Copy of This Notice: You have the right to a paper copy of this notice at any time, even if you have previously agreed to receive this notice electronically. You may print a copy of this notice or you may contact the Privacy Officer.

CHANGES TO THIS NOTICE

We reserve the right to change this notice and Bon Secours 24/7's privacy practices. We reserve the right to make the revised or changed notice effective for medical information we already have about you as well as any information we receive in the future. We will post a copy of the current notice on the Service.

QUESTIONS OR COMPLAINTS

If you have questions or believe that your privacy rights have been violated, you may file a complaint with Bon Secours 24/7 or with the Secretary of the Department of Health and Human Services. To file a complaint with Bon Secours 24/7, contact the Privacy Officer. You will not be penalized for filing a complaint.
